Mickey Silberman

Mickey is the founder of, and a Shareholder with, Silberman Law PC. For close to 30 years Mickey has represented employers in all areas of employment law, specializing in pay equity, affirmative action, OFCCP compliance and audit defense and Diversity, Equity & Inclusion. 

 

Mickey is recognized as among the nation’s leading experts in the areas of pay equity and systemic pay discrimination. He has vast experience working closely with clients in all industries across the U.S. and internationally to design and conduct pay equity analyses both on a proactive basis and in response to EEOC and OFCCP investigations, state agency enforcement actions, and private litigation. He also advises clients on pay system design and administration to identify and address subtle, often hidden barriers to pay equity. 


For our federal government contractor clients, Mickey has directed the preparation of thousands of annual affirmative action plans across all industries and throughout the country. He has defended hundreds of OFCCP audits and investigations, including many of the Agency’s largest pay discrimination investigations. He often is asked to step in to defend OFCCP investigations “gone wrong” and has an exceptionally strong track record in those investigations. In the last 1,000 OFCCP enforcement matters Mickey has defended, he has obtained Letters of Compliance – the best possible outcome – in more than 99.5% of the audits. 


Mickey spends much of his time counseling employers in area of Diversity, Equity & Inclusion, Mickey works closely with clients to design innovative and effective DE&I programs. He develops creative diversity analytics that allow employers to see what is and isn’t working and how best to “move the needle” on diversity.


Mickey increasingly spends time counseling clients on Environmental, Social & Governance (ESG) issues, with an emphasis on workforce diversity and pay equity. He helps clients develop creative strategies for navigating this quickly emerging and challenging area.


Mickey is also one of the nation’s premier public presenters-trainers on a broad range of topics including pay equity, diversity, OFCCP compliance, sexual harassment and managing effectively under the EEO laws. 


He also is co-founder and Co-Chair of the Institute for Workplace Equality, a leading national employer association. Through his role with the Institute, he meets with EEOC, U.S Department of Labor, and other federal and state agency leadership to present the employer community's perspective on proposed laws and regulations and agency enforcement trends.


When not helping clients, Mickey often can be found in his “happy place” hiking up or relaxing on top of a “14er”, one of Colorado’s 14,000 foot peaks.
